Terms of Service — InstantIoT
Last updated: September 18, 2026
- InstantIoT is provided as-is. No warranty, no guarantee that it will work for your specific hardware project.
- You are responsible for the boards you connect, the code you upload, and what they do in the physical world.
- The mobile app is proprietary (free to use). InstantIoT Cloud is an optional hosted service with a free plan and a paid Maker subscription. The InstantIoT Server is AGPLv3. The Arduino library is MIT.
1. Acceptance of these Terms
By downloading, installing, or using the InstantIoT mobile app, by creating an InstantIoT Cloud account, or by running the InstantIoT Server or Arduino library, you agree to these Terms of Service (« Terms »). If you do not agree, do not use them.
These Terms are a contract between you (« User ») and Djoufack Tsobeng Jean Loick, the maintainer of InstantIoT (« we », « us », « the Maintainer »).
2. What InstantIoT is
InstantIoT lets makers build a mobile dashboard for their Arduino-compatible boards and connect them — next to the board over Wi-Fi or Bluetooth, through a server they host, or through the InstantIoT Cloud. It is composed of four components, each governed by its own terms:
| Component | What it is | License / terms |
|---|---|---|
| Mobile app (Android, iOS) | Dashboard builder; talks to your boards directly, through your server, or through the Cloud | Proprietary — free to use under these Terms |
InstantIoT Cloud (instantiot.cloud) |
The relay hosted by the Maintainer: history, automations, notifications, reachable from anywhere | This service, under Section 4 |
| InstantIoT Server | The same relay, open source, that you install on your own machine | GNU AGPLv3 |
| Arduino library | Runs on your ESP32 / ESP8266 / Arduino UNO R4 WiFi boards | MIT |
The Server and the Arduino library are open source: their own license files govern their use, distribution, and contribution rules. These Terms cover the mobile app, the Cloud, and how the pieces interoperate.
3. License granted for the mobile app
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the InstantIoT mobile app on devices you own or control, for personal or professional projects.
You may not:
- Reverse engineer, decompile, or attempt to extract the source code of the mobile app.
- Repackage, redistribute, or commercialize the app or any modified version of it.
- Remove or alter branding, copyright notices, or attribution.
- Use the app to send unlawful, harmful, or fraudulent content, or to interfere with third-party systems.
4. InstantIoT Cloud — account, plans, subscription
Account. The Cloud needs an account: an email address you control and a password. You are responsible for keeping them private and for what happens under your account. One person, one account. You must be at least 16, or the age of digital consent where you live.
What the Cloud does. Your boards and your phone connect to instantiot.cloud; the Cloud stores your projects, devices, the values your boards send, and the automation rules you write, and it runs those rules and sends the notifications and emails they produce. The Privacy Policy says what is stored and for how long.
Plans. The Cloud comes with a Free plan — enough for a first project, with limits on the number of boards, automations, notifications and history depth — and a paid Maker subscription that raises those limits. The current limits and prices are shown in the app (Profile → See the plans) and on instantiot.io. We may change the limits of the Free plan or introduce new plans; we will not lower what a paid subscription already includes during its current period.
Subscription. Maker is a recurring subscription bought through Google Play (Android) or the App Store (iOS), monthly or yearly, billed by the store under its own terms. It renews automatically unless you cancel it in your store account before the end of the period; cancelling keeps your plan until that date, then your account returns to Free. Refunds follow the store’s policy. Prices may change for the next period, with notice through the store.
Returning to Free. When a subscription ends or is not renewed, your account keeps its data for a grace period (currently 30 days) during which you can renew without losing anything. After that, the Free limits apply: nothing is deleted, but what exceeds the limits can no longer be added to, until you renew or remove it.
Fair use. The Cloud is for your own boards and projects. Do not use it to relay traffic for others, to run a service for third parties, to send unsolicited notifications or emails, or in a way that degrades it for other makers. We may throttle or suspend an account that does.
Availability. We run the Cloud with care but without a service-level guarantee. It may be unavailable for maintenance or for reasons beyond our control (Section 12). Do not rely on it, alone, for anything where a missed alert would cause harm (Section 5).
Deleting your account. You can delete your account at any time from the app (Profile → Account → Delete my account). Your projects, boards, history, rules and push tokens are deleted at once. An active subscription must be cancelled in your store account separately; deleting the account does not refund the current period.
5. Your responsibilities
You are responsible for:
- The hardware you connect (ESP32, Arduino, sensors, actuators, relays, motors, etc.).
- The sketches you upload on the boards and the physical effects they trigger (turning a relay on, moving a servo, opening a door, etc.).
- The networks you operate (Wi-Fi, server hosting, exposure to the public Internet if you choose to expose your InstantIoT Server beyond your LAN).
- The automation rules you write and the actions they take on your boards, including while you are not watching.
- The legality of your project (building automation, electrical safety, radio frequency compliance, and any local regulation that applies to your use case).
- Backups of your data on your phone and on a self-hosted server. On the Cloud, we keep backups for the service’s own continuity; they are not a substitute for exporting a project you care about.
You agree not to use InstantIoT to control safety-critical systems, medical devices, life-support equipment, or any system where a failure, a dropped connection or a missed notification could cause death, serious injury, or significant property damage. InstantIoT is designed for makers and prototyping, not for safety-critical applications.
6. No warranty
The mobile app, the Cloud, the InstantIoT Server, and the Arduino library are provided « as is » and « as available », without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that:
- The software or the Cloud will be uninterrupted, error-free, or free of vulnerabilities.
- The communication between your phone, the server, and your boards will always succeed (Wi-Fi drops, outages, board crashes happen).
- A notification or an email will always be delivered, or delivered in time.
- Sensor values displayed in the app are accurate or up to date — they reflect what your boards send, which is yours to validate.
- The software will be compatible with any specific hardware, OS version, or future Android / iOS release.
Where local law does not allow the exclusion of certain warranties, those warranties are limited to the minimum permitted by that law.
7. Limitation of liability
To the maximum extent permitted by applicable law, the Maintainer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:
- Loss of profits, revenue, business, or data.
- Damage to hardware, including ESP boards, sensors, actuators, or connected appliances.
- Damage to property caused by an actuator or relay controlled through InstantIoT (door opener, watering pump, heater, etc.), whether by a tap in the app or by an automation rule.
- Service interruptions, dropped connections, missed alerts, or any consequence of relying on the app or the Cloud for time-sensitive operations.
- Security breaches of your self-hosted InstantIoT Server caused by your own configuration or exposure choices.
In any case, the cumulative liability of the Maintainer for any direct damages arising out of or in connection with the use of InstantIoT shall not exceed the amount you paid us in the twelve months before the claim, or EUR 50 if you paid nothing, or the local equivalent.
8. Open-source components — separate terms
The InstantIoT Server is licensed under the GNU Affero General Public License v3.0. In particular, if you modify the server and offer it as a network service to third parties, you must publish your modified source code under the same license.
The InstantIoT Arduino library is licensed under the MIT License, which allows you to use, modify, and redistribute the library freely, including in commercial products, provided the copyright notice is preserved.
These open-source licenses are separate from these Terms. When you use the Server or the Arduino library, you accept those licenses for those components.
9. Third-party services
The mobile app uses Firebase Crashlytics and Firebase Analytics from Google for crash reporting and pseudonymous usage statistics, and Firebase Cloud Messaging / Apple Push Notification service to deliver alerts. Account and getting-started emails are sent through Brevo. See our Privacy Policy for details. Google’s services are subject to Google’s Terms of Service.
The mobile app is distributed through Google Play (Android) and Apple’s App Store (iOS); your installation, updates and in-app purchases are subject to those stores’ own terms.
10. Privacy
Our handling of personal and technical data is described in the Privacy Policy (https://instantiot.io/privacy-policy/), which is an integral part of these Terms. Please read it.
11. Changes to these Terms
We may update these Terms when the app, the Cloud, or the ecosystem evolves. The « Last updated » date at the top is the source of truth. Material changes will, when reasonably possible, be surfaced in-app at the next launch. Continued use after an update constitutes acceptance of the new Terms.
12. Termination
You may stop using the app at any time by uninstalling it, and delete your Cloud account from the app.
We may suspend or terminate your access to the app or the Cloud, or the availability of any feature, with or without notice, in particular if:
- You materially breach these Terms, including the fair-use rules of Section 4.
- A component must be discontinued for technical, legal, or security reasons.
- Required by applicable law or platform policies (Google Play, Apple App Store).
If we discontinue the Cloud, we will give reasonable notice and a way to export your projects. Termination does not affect any rights or obligations that, by their nature, should survive — including Sections 6, 7, 8 and 14.
13. Force majeure
The Maintainer is not liable for any delay or failure to perform caused by circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network, hosting or power outages, or strikes.
14. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the province of Quebec, Canada, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the use of InstantIoT shall be submitted to the exclusive jurisdiction of the courts located in Montreal, Quebec, except where local consumer-protection law gives you the right to litigate in your country of residence — in which case that right is preserved.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full effect.
16. Entire agreement
These Terms, together with the Privacy Policy and the open-source licenses of the Server and the Arduino library, constitute the entire agreement between you and the Maintainer regarding InstantIoT, and supersede any prior agreement on the same subject.
